How can one obtain land for investment?

The land offer intended for investment is present in two markets:

  • The private market, which includes land or real estate owned by individuals and available on the free land market.
  • The Institutional market, which concerns land belonging to the private domain of the State, regulated by Law No. 23-17 setting the conditions and modalities for granting economic land for investment projects.
What is economic land belonging to the private domain of the State?

Economic land belonging to the private domain of the State for investment projects includes land available within expansion zones, tourist sites, new city perimeters, industrial zones, activity zones, technological parks, as well as residual assets of dissolved public enterprises and surplus assets of economic public enterprises. (Executive Decree No. 23-486 of December 28, 2023).

Which organization manages economic land?

The Algerian Investment Promotion Agency is delegated by the State to manage and allocate economic land through its one-stop shop.

In this capacity, it is responsible for:

  • Deciding, in consultation with the relevant sectors, on the orientation of available land for development by public land development agencies for industrial, tourist, and urban purposes (currently being created);
  • Managing and promoting the state’s economic land portfolio for concession;
  • Maintaining and updating the file of economic land suitable for real estate investment, containing the characteristics of each property;
  • Providing investors with all information regarding real estate availability through the investor’s digital platform;
  • Acquiring, on behalf of the state, any privately-owned land suitable for investment projects;
  • Granting economic land belonging to the state’s private domain to investors through direct concession convertible into transfer;
  • Monitoring and supporting investors until their investment projects are realized;
  • Participating in the development of urban planning instruments to express investment needs.
Who is eligible to apply for economic land?

Any individual or legal entity, whether national or foreign, resident or non-resident, as defined by Law No. 22-18 of July 24, 2022 on investment, carrying an investment project, can apply for a concession for the transfer of real estate from the state’s private domain.

How do you obtain economic land?

The applicant must submit their request via the investor’s digital platform managed by the Agency, which is the sole and unique means of submission, following the process outlined below:

What is the amount of the concession fee?

The concession convertible into transfer is granted upon payment, by the concessionaire, of an annual lease fee, starting from the date of commencement of the investment operation, duly certified by the Algerian Investment Promotion Agency. The amount is calculated according to modalities set by legislation.

What are the rights and obligations of the concessionaire?

The rights and obligations of the concessionaire are strictly and comprehensively defined in the specifications that they sign, committing them to carry out the investment project in full compliance with its clauses and conditions, which are an integral part of the concession agreement.

Rights of the investor concessionaire:

●     Right to a building permit,

●     Right to a demolition permit if they wish to demolish the constructions

●     erected on the land they are concessionaires of,

●     Right to mortgage the concession to secure a bank loan,

●     Right to sublease or transfer the concession, after completion of the

●     investment project;

●     Right to transfer the concession by inheritance.

●     Full ownership, established by a notarial deed, of the buildings erected.

●     Right to request the conversion of the concession into transfer, once the investment project is completed and operational.

Obligations of the investor concessionaire:

The concessionaire is subject to a series of obligations outlined in the specifications, but other main commitments include:

●     Completion of their investment project within the specified timeframe. (Possibility of extension, subject to conditions, of the deadline).

●     Implementation of the project for which the concession was granted.

●     Annual payment, at term, of a lease fee representing the consideration for the enjoyment of the conceded property, which takes effect from the date of commencement of the investment project operation.

●     Maintenance of the economic purpose of the granted land after the project is completed.

How can the concession be converted into transfer?

The concession is converted into transfer by the Algerian Investment Promotion Agency, at the request of the concessionaire, after completion of the project in accordance with the clauses of the specifications, obtaining the conformity certificate, and its operational entry duly certified by the competent authorities and bodies.

Are concessions granted prior to the new granting system affected?

These provisions also apply to concessions granted prior to the promulgation of Law No. 23-17 laying down the conditions and modalities for the grant of economic land belonging to the state’s private domain intended for the implementation of investment projects.

Subject to the conditions set by the aforementioned Law No. 23-17, the conversion of the concession into transfer is formalized by a deed drawn up, at the initiative of the Algerian Investment Promotion Agency, by the domains services territorially competent.

What are the recourse options?

Any applicant who considers themselves aggrieved may submit a complaint to the Algerian Investment Promotion Agency by any means, within the deadlines set by Presidential Decree No. 22-296 of September 4, 2022, from the date of notification of the decision on their concession request. In case of an unfavorable outcome to the complaint, notified by the Agency, the applicant may appeal to the national high commission for investment-related appeals within the deadline set by Presidential Decree No. 22-296 of September 4, 2022, from the date of notification of the decision on their complaint.
